Falana Cites Supreme Court Ruling, Says Makoko Demolitions Are Illegal

Human rights advocate Femi Falana has stated that the demolition of homes or forced evictions in waterfront communities such as Makoko is against the law. Falana made the remarks during a Sunday interview on Arise Television, emphasizing that Nigerians have a constitutional right to housing and dignity, which the government is obligated to respect.

He clarified that before any demolition takes place, the government must engage residents in dialogue and provide adequate alternative housing. Falana also criticized the recent use of tear gas on peaceful protesters, calling it unjustified and unlawful.

Drawing on over 35 years of experience handling demolition cases in Lagos, Falana pointed to a Supreme Court ruling from two years ago which determined that state governments do not have jurisdiction over inland waterways. Therefore, he argued, demolitions in waterfront areas like Makoko lack legal backing.

“Development is not the issue,” Falana stated, “but it must be carried out humanely and in accordance with the law.” He condemned operations conducted at night involving tear gas and destruction of property, stating such actions are illegal.

Falana reaffirmed that any government-led displacement must be preceded by consultation and clear resettlement plans to uphold the dignity and shelter rights of citizens.
