How to File a DMCA Takedown Notice

To be valid and actionable under the DMCA, your notice must include all of the following:

Notices that do not include all of the above information may not be processed. Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including legal costs and attorney fees.

Our Response Process

Upon receipt of a valid and complete DMCA takedown notice, we will:

— Review the notice and the content in question within a reasonable timeframe, typically within 5 business days.

— Remove or disable access to the allegedly infringing content if the notice is valid and we are unable to immediately determine that the use is lawful.

— Notify the person who posted the content, if applicable, that it has been removed or disabled.

— Keep a record of the notice in accordance with our legal obligations.

Counter-Notice Procedure

If content you submitted to Daily Digest Online has been removed or disabled as a result of a DMCA takedown notice and you believe the removal was made in error — for example, because you have the right to use the material or the complaint was filed in error — you have the right to submit a counter-notice.

A valid counter-notice must include the following:

1. Your full name, address, telephone number, and email address.

2. Identification of the material that was removed and the location (URL) where it appeared before removal.

3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action to restrain the allegedly infringing activity, we may, at our discretion, restore the removed content.

Repeat Infringers

It is our policy to terminate the publishing privileges of contributors or users who are found to be repeat infringers of copyright in appropriate circumstances.
